Thanks for using RenoFi Designs to kick start your renovation!
These Terms of Use (“Design Terms”) apply to your use of RenoFi Designs, and the website Terms of Service (“Website Terms”) apply by accessing RenoFi Designs through www.renofi.com (the “Site”). By using RenoFi Designs, you are agreeing to these Design Terms and the Website Terms, which results in a legal agreement between you and Renovation Finance LLC and/or Renovation Technologies Holdings Inc. (collectively, “RenoFi”, “we” and “us”). Please read these Design Terms and Website Terms carefully. If there is a conflict between these Design Terms and Website Terms, these Design Terms will control with respect to RenoFi Designs.
Your use of RenoFi Designs is subject to an AGREEMENT BETWEEN YOU AND US TO ARBITRATE DISPUTES that may arise from your use of RenoFi Designs. By agreeing to arbitrate, YOU AND US ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
RenoFi Design Services
Design Services
RenoFi Designs is professional space and floor plan design services conducted by experienced designers who specialize in spatial and floor plan design. The RenoFi Designs services consist of an initial consultation meeting, up to 10 hours of professional spatial planning design services, a second consultation meeting to discuss up to three floor plan design concepts, and a final design package.
RenoFi Designs uses spatial planning design experts to provide the RenoFi Designs services and create the design plans. Note, these are not licensed architects or certified/accredited interior designers, or general contractors.
Design Plans
The final design package includes 3D conceptual design(s) of the floor plans and/or spatial planning concepts discussed during the design consultation meetings, and estimated or range of costs for the design project. All design plans are preliminary and conceptual. Design plans are based on photos and/or scans you provide, and may not reflect exact measurements or conditions. Design plans provided through RenoFi Designs, even those marked or identified as “final” plans, are not meant to replace architectural or structural engineering plans, and are not to be used for construction or building. If you decide to move forward with your project, you will have to obtain at your expense additional construction/building plans that meet requirements for your locality. RenoFi does not research local regulations around building setbacks, impervious surfaces, and similar requirements, and consequently, these requirements (even if they could impact the design) are not reflected in any prepared design plans.
Cost Estimate
The design consultation meetings may include discussions of, and the final design package will include, cost estimates. Cost estimates are preliminary and for illustrative purposes only. RenoFi prepares the cost estimate; RenoFi may consult its network of contractors to help prepare the cost estimate but this cost may not reflect the price at which the contractor you select will perform the work.
The cost estimates are based on current market conditions and our understanding of your requested level of finish, and are reflective of the design concepts represented in the delivered design plans. Your actual project cost may be higher or lower than the cost estimate, and will be different if you change the scope of work, level of finish, and/or other elements of the design project. Cost estimates do not include the costs that may be required to obtain architectural, structural engineering and/or additional construction/building plans that meet requirements for your locality, permits needed for your project and locality, and other costs not directly related to the elements of the design plan.
Cost estimates may also include information on potential financing options; financing options are presented by a separate division of RenoFi which offers loan brokering services. Please read the “Relationship with RenoFi” for more information.
Payment
The first consultation meeting is free of charge, and requires no commitment to continue with obtaining design plans through RenoFi Designs. Services beyond the first consultation meeting require payment. RenoFi Designs charges a flat, one-time fee of $899 plus tax (if applicable in your state) for up to 10 hours of spatial planning design time and plans for one major space (ex. kitchen, master bathroom, master bedroom, etc.). Design services for projects that reflect multiple major spaces will have an additional cost that is determined on a case-by-case basis but will be communicated to you before being charged.
RenoFi Designs only accepts payment by major credit cards at this time. RenoFi Designs does not charge any credit card surcharges or fees. RenoFi Designs uses a third party payment processor, Stripe, to process your credit card payment. Please refer to Stripe’s terms and privacy policy for more information on how Stripe handles your information. RenoFi does not store or maintain any of your credit card information.
Eligibility to Use RenoFi Designs
In order to use RenoFi Designs, you must be at least eighteen (18) years old or the age of majority in your state, and able to enter into legal contracts; agree to these Design Terms and Website Terms and any other linked terms or conditions that form part of your agreement with us; be located in the U.S.; and not be included on any lists maintained by the U.S. prohibiting transactions with and the export of U.S. products/services to certain entities, people and jurisdictions. We reserve the right to refuse service and change any of these eligibility requirements at any time.
By using RenoFi Designs, you represent and warrant that you meet all of the above requirements and that you won’t use the design services in a way that violates any laws or regulations. By making this representation and warrant, you are making a legally enforceable promise to us.
Relationship with RenoFi
RenoFi Designs is an optional design service offered by RenoFi. RenoFi Designs is not a separate company or entity. RenoFi operates as a personal loan and mortgage loan broker in nearly every state. You may use the RenoFi Designs service without using RenoFi’s loan brokering services; and you may use RenoFi’s loan brokering services without using the RenoFi Designs service. Each service is independent and completely voluntary.
You may receive email and other forms of advertising from RenoFi for RenoFi Designs, RenoFi’s loan brokering services, and/or other products and services offered by or through RenoFi. You can opt-out of email advertising through the unsubscribe link contained in the email footer, and from mail advertising by emailing [email protected].
Privacy & Use of Your Content
RenoFi uses and discloses your Content as described in its Privacy Policy. The section “How We Use Your Information” describes how RenoFi uses your Content, and the section “Sharing and Disclosure” describes the circumstances and to whom it shares or discloses your Content.
Third Party Apps
RenoFi uses or recommends the use of certain third party applications to facilitate the RenoFi Designs experience. RenoFi is not affiliated with these applications or companies that publish the applications, nor does it receive any compensation from these applications or companies; the recommendation to use these applications is for convenience and ease of use only. Your use of any third party applications is solely between you and the applicable third party. When you use these third party applications, you are agreeing to their terms and conditions for use and their privacy practices. You should review those terms prior to using the applications.
RenoFi is not responsible for the behavior of these third party applications or companies, nor the privacy, security, or integrity of any third party application or their practices or policies. RenoFi makes no representations or guarantees and assumes no liability of any kind for your use of third party applications.
Proprietary & Feedback Rights
Upon payment and delivery of the design plans, you shall have all right, title and interest in the design plans but you understand that RenoFi retains a copy of the design plans on its system. You grant RenoFi a perpetual, irrevocable, royalty-free, non-exclusive, worldwide, sublicensable, and transferable license to use, reproduce, publicly display, distribute, modify, and publicly perform the design plans, and all iterations thereof, in our discretion and as we see fit. You shall retain all rights, title and interest to the photos, material and information (including your personal information and the personal information of others) you provide to RenoFi Designs in the course of receiving design services, or which Renofi otherwise retrieves or accesses at your direction or with your permission (collectively, your “Content”).
You grant us permission to use or disclose your Content (including any personal information) as necessary to provide RenoFi Designs services to you and/or as otherwise permitted by these Design Terms and RenoFi’s Privacy Policy.
We may ask you to provide suggestions, comments, input or other feedback (collectively, “Feedback”) regarding RenoFi Designs. If you provide any Feedback, you grant RenoFi a perpetual, irrevocable, royalty-free, non-exclusive, worldwide, sublicensable, and transferable license to use, reproduce, publicly display, distribute, modify, and publicly perform the Feedback in our discretion and as we see fit. RenoFi may use any Feedback to improve RenoFi Designs or develop new products, features and/or services. You understand that you will not receive any compensation or attribution for your Feedback. Any Feedback you choose to provide is entirely voluntary.
No Warranties
RENOFI DESIGNS IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RENOFI MAKES NO WARRANTIES, PROMISES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, IN RELATION TO RENOFI DESIGNS. Refer to the “Disclaimer of Warranties” section in RenoFi’s Website Terms for more detailed information.
Limitation of Liability
Your use of RenoFi Designs is subject to the limitation of damages and liability described in the “Limitation of Liability” section in RenoFi’s Website Terms.
Dispute Resolution by Binding Arbitration
